    Kaepernick files collusion grievance against NFL

    -Colin Kaepernick has filed a grievance under the NFL's Collective Bargaining Agreement, a further escalation in his tense relationship with the league that began with his refusal to stand for the playing of the national anthem in protest of the treatment of racial injustice in the United States.

    What does Colin Kaepernick allege in his case?

    Kaepernick alleges that the 32 NFL owners have "colluded" or entered into a prohibited agreement with either another club or the league to not sign him to a contract this season. Interestingly, the grievance was filed directly by Kaepernick's attorney, Mark Geragos, and not through the NFL Players Association. The NFLPA appears to be staying on the sidelines even though a victory by Kaepernick could well be a victory for all NFL players.

    What is collusion?

    The NFL's Collective Bargaining Agreement specifically forbids "collusion", which is defined as a club entering into any agreement, express or implied, with any other club or the league to not sign any particular player.

    What chance does Kaepernick have of winning?

    Kaepernick's chances will rely heavily on any potential evidence available to prove collusion. In a private proceeding before an independent arbitrator, not a court, Kaepernick will bear the burden of demonstrating by a clear preponderance of evidence that there was a forbidden agreement between NFL teams and/or the league office that amounted to collusion and that the forbidden agreement caused him economic harm...

    He absolutely has no chance of winning if they actually look for real evidence and don't have it, other than judging it just because he hasn't been hired.

    If he were any good, he wouldn't be in this position. The League wouldn't care about his political agenda, they care about the all mighty dollar and if he were bankable, they'd pick him up with the quickness. Evidently, he's lacking in the skills department.

    Yeah, he's a backup QB at best now, plus he has all the drama surrounding him. No team is going to hire him. Too much of a distraction. If this was Tom Brady doing this, Tom would still have a job because the owners will put up with just about anything for talent. Kaepernick is an average if not worse QB now.

    People keep talking about him being blackballed. Even if he is, that's not against the law. Now collusion to blackball is illegal. But the owners have every right to NOT hire any person for whatever reason they don't want to hire them as long as it isn't for a reason that does violate law such as race, etc.

    What really gets me is how overall most of the owners and the NFL is basically cowering to them, or at least have been. Why don't they say just say that this is a business, and we pay you to do a job, and if you do something we don't like we'll fire you? Try protesting at IBM if you have a job there and see how long you last. We're corporate America just like IBM is. Yeah, it's your right to protest and it's our right to fire you if if disrupts business if it affects the workplace or the bottom line. All the political correctness is what is keeping this thing going.
