Neighbors?
So I have a wood fence, that has been pretty beat up by my neighbors. Who bought the house 2 years (ish) but they have continued to abuse the fence and it's falling apart.
I approached them about a month ago, asking if they would split the cost for a chain link fence, the cost would be reasonable for the both of us. They declined stating that they want a wood fence for privacy, mind you, it's a 4 foot fence, in the front yard....not much privacy to be found in the front yard. So I have placed a letter on their door stating that I will be taking down the fence, letting them have "notice" so to speak.
Boards are exposed, nails, and really needs to come down. She runs a in home day care, so kids are there daily and technically it's "my" fence as it was installed by my family. I am concerned about the potential liability if it is not addressed soon.
So now I have informed them that I will be taking it down, and let them know that I won't be replacing it, and it will leave their property no longer enclosed. My property doesn't have a front gate, it's open so it doesn't bother me much.
Is that a bad thing? Opinions? Thoughts? Thank you in advance.

You have every right to do what you want to with your fence. If they run a day home, taking care of the children is their responsibility and, especially if it's creating a hazard, you need to take care of it. You're doing the right thing.

Legally yes.....but some neighbours will never do anything to fix their half

And this is California, so there really isn't anything I can do except remove it. And remove any liability that can come from the damaged fencing. It's sad that my neighbor doesn't want something nicer or something that will stand the test of time, as there are ways to provide privacy outside of wood fencing, but it's fine. Frustrating, but fine.
A project in the making for Sure. Should only take me an hour or two to knock it down. The posts will be the hardest part.

I think if the fence is a hazard, then it needs to come down. Just think about how you're going to deal with the little darlings that will now be coming over onto your property.
