    Auto Accident - value?????

    With the whole accident situation, I received a letter from the party's auto insurance. Stating what the maximum amount that insurance will pay out.
    And the insurance company addressed the letter to the two people who lost their life, and myself. Including our addresses. And that we need to "discuss and agree" how that money is to be divided between the three people who have injuries and not pursue the insured for anything else.

    How do I place a value on the loss of those two people who died? How do I even begin to put a value on my own pain and suffering when I weigh it against the loss of the two people?

    How am I suppose to even do that?? Since yesterday, I have been asking God, how do I even do this? He spared my life, and called two people home. And I am suppose to place a dollar value on their loss!? On my own gift of life! My own pain that I am experiencing, physical and emotionally. I am alive, and some what okay.

    I am really upset, confused about what I should do here. Or even how to begin to attempt this task. I am really lost here.

    Do any of you ladies have some input on this? I am praying about it, and asking Him for peace and wisdom for this. But I could use some help here please. My sister stated that I needed to go through my own insurance company and let the family have all of the funds available.

    I attempted to do that, and my insurance company told me that my injuries will need to go through the person who caused the accident. My insurance took care of my vehicle and I was able to get another vehicle very quickly, but as for my injuries, it's suppose to go through the other insurance, at least according to my insurance person.

    I find it very odd that this letter is coming prior to the completed police report. I talked with a friend of mine this morning, and I will contact my companies insurance agent and ask him about this whole process. Maybe he can offer some helpful insight into the insurance world.

    First and only thing you should do is get an attorney ASAP! They already have a legal team and this puts you at an extreme Disadvantage!

    For those that do not know.

    Three weeks ago I was involved in a very serious accident while driving home from a company Christmas Party. I did not drink, and choose to not stay the night as I wanted to be home with my son. It was about 915 pm when it happened, the roads were pretty dry, but a storm was coming in and traffic was slowing down due to something farther up the freeway, so I was only going about 15-20 MPH when I was hit from behind. The sad part, is that while I have "minor" injuries and am struggling with some PTSD and some lower back issues, the vehicle that hit me, those two people lost their lives as their car caught fire and they were trapped inside. The driver who hit them, was taken to the hospital for moderate injuries. The CHP informed me that drinking was a factor but they did not know if he was over the limit.

    That is the cliff notes version. So maybe that will help you in your response to my question.

    Any responses are welcome and I appreciate the input.

    Sharon take your time, don't feel rushed into making a quick decision. There are many attorneys that handle cases like these on contingency, meaning you don't pay anything if they agree to take your case, they just get a percentage of the settlement after its done.

    LCash has it .. get an attorney, right now!

    Don't contact that insurance co at all.. just remember, their job is to get as much money as they can from people, and give back as little as possible.

    Sorry to hear this bad news.

    I would work with an attorney and medical professionals to determine a fair assessment of my pain and suffering. I would ask questions such as: How severe is my PTSD? Am I able to work and sleep? Do the back problems inhibit work or exercise?

    Don't assume that you are required to obey the insurance company's instructions.

    Hire a mob lawyer... one who knows how to defeat the mob lawyers the insurance companies use.

    Make no mistake, they are in the business of paying as little as possible and getting to you agree to not sue them.

    Insurance companies love to rush and intimidate...I agree with the others...get an attorney
