    Why doesn't Trump send it through the Senate first or alternatively, have the judicial system define it as a treaty and therefore illegal ?

    With legal annulment of Obama's decision then Senate backing he would look much better in the eyes of the people, apart from just the hard core that approves of most things he does. Without approval beyond the hard core he may manage to lay out a red carpet for the next Democratic candidate to win a landslide victory in the next election.
