    Wills

    If you don't have a will....get one. I just had another snag in the 'life after Andy' saga. Andy didn't have a will, so everything went into probate. I'm not sure if I shared much of that here on the forum or not, but suffice it to say it was a pain. I'm now dealing with the next small mountain. I just found out that the house that we lived in (which I'm selling) will have to go on a 10 day upset bid status. The court system will not just allow me to sell it; I have to jump through several hoops. So, again....if you don't have a will; get one!

    Lista, I’m so sorry you’ve had to go through all of this! And still going through.

    Rog and I have had wills since our first baby was 10mo old. Simple ones, but we had them. Then in 2010, we did a change up cuz we have adult children now, but still pretty simple.

    Single ppl need wills too. Just to keep it easy for their families.

    I bugged our daughter and her husband to get wills till they did. And her best friend is a lawyer!

    At my last Steakhouse Investment Seminar Circuit dinner/meeting, the speaker's focus was on Estate Planning. Yes, probate is typically a pain and can be a nightmare, as many can attest. Inaddition, simple wills are often no longer adequate - Living Trusts are often a better way to go, depending on situation.

    But in the last few years, we learned that laws have changed alot, partially due to legal wranglings and messy challenges by relatives to wills. And get this: Now there are all kinds of will add-ons and provisos available, such as the "Bad Son-in-Law" add-on.

    The takeaway was, even if you did your will a few years ago, it's worth reviewing and considering an update.

    Interesting you should mention the "Bad Son-in-Law" add on... we wrote ours so that if our older son should pass, his partner will get nothing. If they had kids, the money would go into trust for them, managed by someone else, but she would get nothing. Hopefully it holds up because she's nasty enough to sue.

    I have learned from my parent's passing..... make a detailed list of what goes to who, what goes to there and in between. Leave nothing undone or assume "they" will know what to do with ______. What a nightmare, mess and not to mention all the angry people involved...

    You’d think, but no. I get it; there are lousy parents out there drugging and boozing away all their money. I’m not one of those parents. I have to put half of all the house profits into a trust fund for my daughter. It doesn’t matter that I take care of all her needs and that I already have a savings account for her. You’d think the courts would look at each case individually, but I guess they’re too busy.
