    From your link:

In early March 2016, Brailsford was charged with second-degree murder in relation to the incident. Later that month, the Mesa police department, citing several policy violations that included the words "YOU'RE F****D" engraved into his rifle dust cover and unsatisfactory performance, fired Brailsford.

Sounds like the kind of guy that might do something like that.

Sounds like there is no doubt he intended to kill this man....unfortunately when the man reached to pull up his pants it gave the murdering cop the excuse he needed to claim self defense...as we know any sudden movements that are not part of the instruction have paved the way for not guilty verdicts and in some cases that was probably a justified decision...so while it's clear this man had a murderous heart his ACTION at that moment had to be 'protected precedence'.

Did y'all see where the cop who shot the boy running away in the back was convicted?

Bad cops use the thin line to do bad things but the thin line will always remain for the safety of all police officers...They have authority behind them and we as a society MUST respect that authority or our society will collapse into further lawlessness....

And no...I will not respond if anyone takes my comments out of context or tries to spin them as if I said police murdering or acting fearfully or stupidly are justified....I am saying they have a job to do and they are not perfect.....but most are not evil as this man obviously is and he should have been fired long before this incident...but the thin line has to remain for the good guys...like I told someone about dogs attacking bikers..dogs are supposed to be restrained legally and if they are not the biker is not obligated to wait till the dog bites to defend themselves..so if someone's sweet Foo Foo comes at them at a trot and teeth bared even if he has never bitten before, they are not obligated to wait and see if they are going to be the first....that thin line of perception can be enhanced through intense training but it can never be perfect and it cannot be removed or we will have a lot of dead police officers...no doubt that reflex has saved more lives of officers than produced victims...

According to a police report, Daniel Leetin Shaver (December 29, 1989 – January 18, 2016), a pest-control worker and resident of Granbury, Texas, had been staying at a Mesa La Quinta Inn & Suites on business. He invited two acquaintances to his room for drinks. There he showed them a scoped air rifle he was using to exterminate birds inside grocery stores. At one point the gun was pointed outside his hotel window, prompting a witness to notify the front desk; the police were immediately called. Upon arrival, police gave Shaver and his acquaintances detailed orders for several minutes, with frequent admonitions that failing to comply with them would get them shot. Eventually, Shaver was ordered to crawl on the floor towards them. While complying with their request, Shaver, who was intoxicated and could be heard sobbing, begging officers, "Please don't shoot," brought his hands toward his waist. Brailsford yelled at Shaver that if Shaver did anything whatsoever that deviated from his instructions he would shoot him and he probably wouldn't survive. The officer told Shaver to put his hands up in the air and not to bring them down for any reason. A few seconds later, the officer ordered Shaver to crawl towards him, to which Shaver complied. Shaver then reached his right hand back towards his waistband, at which point Brailsford can be heard yelling "Don't!" while simultaneously opening fire with his AR-15 rifle, striking Shaver five times and killing him almost instantly. Shaver was unarmed.[2][citation needed

Ok we need to remember a few things....if you were a guest at this hotel...you did not know Shaver or his career and you saw him point a rifle out the window what would you do?

NO DOUBT this officer over reacted and seems to be far to eager to kill this man....but based on his gun was he swat?

Sometimes I think we forget we know things in hindsight about a situation that those involved at that moment do not KNOW...

Based on the video I understand why he walked although 2nd degree murder was a good charge but I understand why he walked....it is only in hindsight we know he was not reaching for a gun....and in hindsight we know why he was terminated....he certainly had other options...there was another officer who could have gone over and checked for weapons while he held him at gunpoint...

I recall an officer, think in Florida...where they encountered a man leaving a convenience store and the man reached in his pocket supposedly for Id I think? Came out with a gun and shot the officer....had the officer shot first and there was no gun...murder? no...

As I said there is a thin line and the line must remain....

PS...does ANYONE here believe it's very foolish to point a rifle out a hotel window in clear view of families at a pool below?

I won't defend the murderer at all, nor will I defend the citizens who yelled "Fire!".

That cop was not in fear for his life, he methodically constructed a situation and murdered a man, cold blooded.

So you and your kids are playing at a hotel pool and you see someone pointing a rifle and you would just dismiss it.

I agree regarding this cop...he USED a necessary thin line to satisfy his own evil...that is why he was fired for other infractions...

In Viet Nam veterans exposed to civilians armed with bombs had to begin to make judgement calls and no doubt sometimes made the wrong ones....

People in dangerous positions of authority make mistakes so the thin line of judgement and intuition are necessary....some like this evil man use it to fulfill their own evil heart...not defending or justifying...just stating an objective fact...

And I would be on the phone calling 9-1-1

I would NOT want them to act like this Officer did but would not assume the gun pointing out the hotel window was just an exterminator showing off how he kills birds...

Fact is if he had not been killed he would have likely been fired...

We have one or more officer involved shootings every month now in OK. We had an incident last week where a man with a warrant against him pulled out a gun and shot a detective twice. The detective is ok.

    ......

He also later told the court that he doesn’t remember being told that Shaver was scaring people with his rifle, and was looking for a target.

“You had no information about Mr. Shaver’s intent. No one ever gave you any information about why he had a rifle or anything in his room,” Charbel said.

    “That’s true,” Elmore replied.
